NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that on July 6, 2020, a public hearing as required by Section 147(f) of the Internal Revenue Code of 1986 will be held with respect to the proposed issuance by the California Municipal Finance Authority (the “Authority”) of its revenue bonds in one or more series in an amount not to exceed $30,000,000, including but not limited to revenue bonds issued as part of a plan to finance or refinance the facilities described herein (the “Bonds”).  The proceeds of the Bonds will be used to: (1) finance and refinance the acquisition, construction, improvement and equipping of a 75-unit permanent supportive rental housing facility for very low-income persons experiencing homelessness and persons with disabilities, to be located at 784 W. Holland Ave. in the City of Clovis, California (the “City”); and (2) pay certain expenses incurred in connection with the issuance of the Bonds.  The facilities are to be owned and operated by UPH Butterfly Gardens, LP, a California limited partnership, or another entity to be created by UPH Butterfly Gardens, LLC, a California limited liability company (the “General Partner”), or by an affiliate of the General Partner.

The Bonds and the obligation to pay principal thereof and interest thereon and any redemption premium with respect thereto do not constitute indebtedness or an obligation of the City, the Authority, the State of California or any political subdivision thereof, within the meaning of any constitutional or statutory debt limitation, or a charge against the general credit or taxing powers of any of them.  The Bonds shall be a limited obligation of the Authority, payable solely from certain revenues duly pledged therefor and generally representing amounts paid by the Borrower.

The hearing will commence at 6:00 p.m. or as soon thereafter as the matter can be heard, and will be held in the City Hall Council Chambers, 1033 Fifth Street, Clovis, California 93612.  Interested persons wishing to express their views on the issuance of the Bonds or on the nature and location of the facilities proposed to be financed and refinanced may attend the public hearing or, prior to the time of the hearing, submit written comments.  Given the current shelter-in-place order covering the State of California and the social distance guidelines issued by Federal, State, and local authorities, the Council Chambers will be open to the public but the City may be implementing social distancing policies and may limit the number of people who may be in the Council chambers. The City is encouraging residents to participate virtually following the directions below.  Persons who are sick are asked not to attend the meeting.  Any member of the City Council may participate from a remote location by teleconference.

Comments by Telephone. Participants wishing to speak to the Council on an item by telephone should contact the City Clerk at (559) 324-2060 no later than 5:00 p.m. the day of the meeting, and will need to provide their name, phone number, and email.  Such participants will be emailed instructions to log into Webex to participate in the meeting.  Staff recommends participants log into the Webex at 5:30 p.m. the day of the meeting to perform an audio check.  All callers will be placed on mute, and at the appropriate time for the caller’s comment, the caller’s microphone will be unmuted. Callers will be able to speak to the Council for up to three (3) minutes.

Written Comments.  Participants are encouraged to submit written comments on any agenda item by submitting the form found at https://cityofclovis.com/government/city-council/city-council-agendas/ up to one (1) hour before the start of the meeting (5:00 p.m.).  Participants are requested to submit a separate form for each item they are commenting on.  A copy of the written comment will be provided to the City Council noting the item number. Participants wishing to make a verbal comment should refer to the instructions below.  Participants should specify if they would like to have their written comment read into the record.  If so, the comment will be read into the record during the public comment portion when the item is heard.  Any portion of the comment extending past three (3) minutes may not be read aloud due to time restrictions, but will be made part of the record of proceedings.  Participants should be aware that any written comments received that do not specify a particular agenda item will be marked for the general public comment portion of the agenda.  If a written comment is received after 5:00 p.m. on the day of the meeting, efforts will be made to provide the comment to the City Council during the meeting.  However, staff cannot guarantee that written comments received after 5:00 p.m. will be provided to City Council during the meeting.  All written comments received prior to the end of the meeting will be made part of the record of proceedings.]
