Court Reaffirms that Cities and Counties May Prohibit or Regulate Deliveries of Cannabis from Outside Their Borders

The Fresno County Superior Court released a ruling yesterday holding that a regulation adopted by the California Bureau of Cannabis Control (“BCC”) in 2018 did not affect the rights of cities and counties to regulate, or prohibit altogether, deliveries of cannabis within their jurisdictions. 

The affirmation came in response to a lawsuit brought by the City of Clovis and 25 geographically diverse local governments against the BCC. The City of Clovis prohibits the commercial manufacturing, sale, and delivery of cannabis.
